Distance Sales Agreement

1. PARTIES

This Distance Sales Contract ("Contract") has been concluded electronically between the parties below, in accordance with the provisions of the Law on the Protection of the Consumer No. 6502 and the Regulation on Distance Contracts.

Hereinafter referred to as the "SELLER" in the contract.

BUYER INFORMATION

The natural or legal person who shops via the website is considered the "BUYER" in accordance with the information provided during the order.

The Buyer is obliged to provide the following information accurately and completely;

  • Name and surname,
  • Phone number,
  • E-mail address,
  • Delivery address

2. SUBJECT OF THE CONTRACT

The subject of this contract is the determination of the rights and obligations of the parties regarding the sale and delivery of the product or products, the features and sales price of which are specified below, which the BUYER has ordered electronically via the SELLER's website zemaygiyim.com.

The BUYER acknowledges that they have been informed about the basic features, sales price, payment method, delivery conditions, and return/exchange terms of the product, and that they have provided approval electronically.

3. PRODUCT INFORMATION AND ORDER PROCESS

Regarding the products purchased by the BUYER;

  • Product name,
  • Quantity,
  • Color and size information,
  • Sales price,
  • Shipping cost,
  • Total payment amount

are presented to the BUYER on the payment screen before the order.

The BUYER is responsible for the accuracy of the information provided during the order placement stage.

4. PAYMENT TERMS

The BUYER performs the total payment for the purchased products using one of the payment methods provided on the website.

Once the payment process is completed, the order is taken into the preparation process.

The SELLER has no obligation to ship products for orders for which payment confirmation has not been received.

5. DELIVERY TERMS

Orders are prepared and delivered to the shipping company after payment confirmation is received.

The SELLER exercises the necessary care to ensure that orders are prepared securely and completely.

Delivery time may vary depending on circumstances such as;

  • Product stock status,
  • Order volume,
  • Working conditions of the shipping company,
  • Public holidays

The BUYER is responsible for ensuring that the delivery address provided during the order is correct and complete.

The SELLER cannot be held responsible for delays caused by incorrect or incomplete addresses.

6. SHIPPING FEES

The shipping policy in the Zemay Giyim online store is as follows:

  • Shipping is free on purchases of 2,000 TL and above.
  • A shipping fee of 200 TL is applied to orders below 2,000 TL.

Shipping fees are displayed to the BUYER during the order placement stage.

7. OBLIGATIONS OF THE SELLER

The SELLER is obliged to;

  • Prepare the ordered products with the specified features,
  • Send the products in an undamaged and unused condition,
  • Protect the confidentiality of the BUYER's information,
  • Provide necessary information regarding the order process

8. OBLIGATIONS OF THE BUYER

The BUYER declares that;

  • The information provided during the order is correct,
  • They will not use payment instruments that do not belong to them,
  • They will inspect the products upon receipt,
  • They accept the terms of the contract

9. RIGHT OF WITHDRAWAL

The BUYER may exercise their right of withdrawal under the Law on the Protection of the Consumer No. 6502 and relevant legislation.

To exercise the right of withdrawal, the BUYER must;

  • Submit their request within the legal period from the date of delivery,
  • Send the product unused and in a condition suitable for resale,
  • Deliver the accessories and packaging sent with the product in full

The provisions of the current consumer legislation apply to processes related to the use of the right of withdrawal.

10. CASES WHERE THE RIGHT OF WITHDRAWAL CANNOT BE USED

The right of withdrawal may not be used under legislation in the following cases:

  • Used products,
  • Products prepared specifically for the individual,
  • Products that are not suitable for resale due to hygiene reasons,
  • Products damaged by the user.

11. RESOLUTION OF DISPUTES

In disputes that may arise from this contract;

The provisions of the Law on the Protection of the Consumer No. 6502 and relevant legislation apply.

The Consumer Arbitration Committee and Consumer Courts to which the BUYER can apply are determined within the framework of the monetary limits and authorization rules specified in the legislation.

12. EFFECTIVENESS

The BUYER declares that they have read, understood, and accepted all terms of this contract while creating an order via the website.

The contract enters into force on the date it is approved by the BUYER electronically.
